Digital Global Access respects your privacy and is committed to protecting the Personal Information that you may provide us when using this Site. This Privacy Policy is to be considered part of the Terms of Use (the “Terms of Use”) which governs your use of this Site in general but placed in a separate document to focus on the privacy policy as it pertains to your permission to use the Site. This Site is published and maintained by Digital Access (“DIGITAL ACCESS”). DIGITAL ACCESS may be referred to in this Privacy Policy as “we,” “us,” “our,” or other similar pronouns.  Any capitalized terms that are not defined in this Privacy Policy have the meaning defined in the Terms of Use.

Purpose

We are committed to respecting the privacy rights of the users of our Site, Services, and Applications. Such biometric information is critical to the operation of the Application and Services and will be used solely during each event for security and access permissions, and will be deleted from our data prior to archiving event data.  In addition, your location may be detected and recorded as GPS location data during the event and will be used solely during the event for security and access permission.  Such data will only be retained for audit or accuracy assessment and shall be deleted promptly when such actions have been completedYOU AGREE ALL SUCH INFORMATION YOU PROVIDE OR SHARE WITH US AND YOUR PARTICIPATION IN THE EVENT REQUIRING USE OF OUR SERVICES AND APPLICATION CONSTITUTES CONSENT AS DEFINED UNDER ALL APPLICABLE LAWS AND REGULATIONS FOR SUCH INFORMATION.

What and Who This Applies To

This privacy policy (“Privacy Policy“), which applies only to information collected via the Site, governs your use of DIGITAL ACCESS’s Site, including: (a) what types of information we collect about you when you use the Site; (b) how the information will be used or disclosed; (c) your rights with respect to our collection and use of your data; (d) to whom we disclose the information; and (e) how we safeguard the information.  This Privacy Policy APPLIES ONLY to DIGITAL ACCESS Sites, Services, and Applications where such applications include those installed on handheld, wearable, or portable devices. We are not responsible for the information practices of any other third party sites, advertisements, offers, content or links that you may share your information with whether through our Site, Service, or Application or on your own through any source. This Privacy Policy applies only to information that you may provide to us, or that we may obtain, through our Site. You may obtain of this privacy policy through our Site or by sending us a request in writing. This Privacy Policy shall be interpreted under the laws of the United States. By providing Personal Information or other information to use through the Site, or otherwise accessing or using the Site, you agree to our privacy practices outlined here, our policies, procedures and processes as compliant under GDPR, and to be governed by enforcement of GDPR requirements under laws of the United States only.

What Information is Collected on this Site?

User-Provided Information

General

We collect Personal Information from users of our Site, for example, through such users’ submissions, registration for and participation in programs and events, transactions with us or third-parties, completion of online forms on our Site, and submission of biometric data such as fingerprints and facial photos or images. Such information is collected, for example, when users register for accounts or engage in programs or events through our Site, or participate in or communicate with others, enter areas or physical locations, use software, connect to social media channels and platforms, use applications or software made available to you by or on behalf of us, post User Content, provide your physical location by affirmative acts or through continuous monitoring by our Application, participate in email or messages discussions, message board, comment section, list serve, blog, vlog, wiki, or other open forum available from, on, or through our Site, submit a comment or question to us in any form or through any medium, or in any other way submit Personal Information to us via our Site. We also collect information regarding your location, participation, and activities within or associated with events and programs.  You may be able to communicate with others from our Site by providing the name, text address, or e-mail address of others to us. Such information will be treated in accordance with this Privacy Policy and applicable law.

Personal Health Information

The Site may request users to provide certain personal Biometrics information, and we will collect this data, which includes (for example) fingerprints, facial pictures or images, or audio statements. This information may be required by our clients in order for the user to participate in a program or event and authorize you to enter or leave certain locations and participate in specific activities. You authorize us to collect this information when you provide it and such authorization shall be considered a valid authorization for all legal purposes.  DIGITAL ACCESS will use this information to run programs and events. In addition, DIGITAL ACCESS will never publish any of your personal information in connection with your use of the Site, Service, or Applications beyond that required by our client to run a program or event and to ensure your proper participation in such programs or events. To protect your privacy, if DIGITAL ACCESS shares your personal information with one of our service providers, such service provider will be required to agree to and comply with the terms of this Privacy Policy. Unless we have your prior written request to do otherwise, DIGITAL ACCESS will share your personal health information only as required to run a program or event with a third party other than one described above in a way that anonymizes your Personal Information and aggregate it with other users’ Personal Information.

Site Usage Information

Cookies

We may use “cookies” to keep, and sometimes track, information about you. They are used to make DIGITAL ACCESS’s Site easier to use, to make its advertising more targeted to appropriate users, and to protect both you and DIGITAL ACCESS. Cookies track where you travel on our Site and what you view and what actions you take. They may store your username and/or password. A cookie may enable us to relate your use of our Site to other information about you, including your Personal Information for the sole purpose of improving and personalizing your experience on our Site.

Clear GIFs

We may use “clear GIFs” (aka “Web beacons” or “pixel tags”) or similar technologies, in the Site and/or in our communications with you to enable us to know whether you have visited a Web page or received a message. A clear GIF may enable us to relate your viewing or receipt of a Web page or message to other information about you, including your Personal Information.

IP Address and Clickstream Data

Our server(s) may automatically collect data about your server’s Internet address when you visit us. We may use this information for internal system administration and to administer our Site. Such information may also be used to gather broad demographic information, such as country of origin and Internet Service Provider. We may also link this information with your Personal Information, but will not share such information when linked with your Personal Information with any third party without your prior consent.

Your Use of Our Application(s)

When you download and use software from the Site, we and our service providers may track and collect usage data. Such tracking technologies in connection with non-browser usage may be disabled by uninstalling the app.

How is the Personal Information used?

We will use the Personal Information you provide to our Site in connection with the features and functions of the Site. We may also use your Personal Information for record keeping, to analyze and track user progress in connection with programs and events, and compare you to other persons or users of the Site in various ways. We may integrate and combine information collected from you through different means or at different times, including both Personal Information and Site usage information, and use such information along with information obtained from other sources, including third parties. This information may be used to present advertisements and other contents to you on the Site in an attempt to customize such content to your interests and preferences. In addition, we may send you notices and otherwise communicate information to you about products, services, companies, programs and events and other information that we think might interest you.

Do we share Personal Information and Site Usage information with others?

Public Forums

When you contribute to a public or semi-public area of our Site the information that you submit will be made available to the general public or others within the semi-public area (for example, your team members or those participating in a program or event). Such information may be imported, exported, distributed, and redistributed by us and others without privacy limitations and once published or displayed may be impossible to remove. Such information may be associated with you by other parties based on the information you disclose or provide.

Event and Program Participation

When you participate in a program or event, or submit information in order to participate in programs or events, such information is kept by DIGITAL ACCESS and may be made available to other participants or the client. Additionally, the Site, Service, or Application(s) may use this information in various other ways, such as data analysis, communicating results via different communication channels, or other information purposes specifically required by our client.

Co-sponsored Programs and Events

Some of our programs and events may be co-sponsored by parties other than our client. In those situations, the information we obtain from you in connection with such programs and events may be shared with co-sponsor. The responsibility for how your information is stored with co-sponsors is the sole responsibility of our client.

Service Providers

We may use third-party partners to help operate our Site, collect and analyze data and information, host, operate or support software, applications and tools and deliver our products and services, and may share your information with such service providers, who will adhere to this Privacy Policy. This is intended to help improve and promote our services. Legally Compelled Disclosures

In the event that DIGITAL ACCESS, or substantially all of its assets, are acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, operation of law, change of control, consolidation or liquidation, your Personal Information may be one of the transferred assets. The terms of this privacy policy will continue to apply to your Personal Information that is transferred to the new entity

Your Access Rights

You may review, correct or change the Personal Information that is stored in your user account on this Site by visiting the profile or account settings area of your account on this Site.  You can change your profile or accounts settings on the Site.

Security

DIGITAL ACCESS will use industry standard practices to protect the security and integrity of all Personal Information provided to this Site. We restrict access to personal information to DIGITAL ACCESS employees, contractors and agents on a need to know basis. However, the client of DIGITAL ACCESS providing you access to our Services and Application may allow personnel to access your personal information and therefore you are subject to the client’s privacy and other policies.

Inherent Risks

No security measures are 100% secure and therefore we cannot guarantee that any information provided by you or collected by us or third-parties will be absolutely safe from intrusion by others, such as hackers.   We have no liability for disclosure of your information due to errors or unauthorized acts of third parties or through events that industry standard practices fail to prevent. Children Under Age 13
